NTSB – meeting on 5 December

clip_image004 The National Transportation Safety Board (NTSB) issued a notice stating that it will meet on 5 December in Washington, DC to consider the report of the fire onboard the small passenger vessel Island Lady near Port Richey, Florida on 14 January 2018. 83 Fed. Reg. 60905 (11/27/18) [].

DOT – revisions to civil penalty amounts

clip_image006 The Department of Transportation (DOT) and its constituent agencies, including MARAD and SLSDC, are amending their various civil penalty amounts in order to account for inflation. The changes enter into effect immediately. 83 Fed. Reg. 60732 (11/27/18) [].

PHMSA – HMR amendments proposed

clip_image006[1] The Pipeline and Hazardous Materials Safety Administration (PHMSA) proposes to amend the Hazardous Materials Regulations (HMR) to maintain alignment with international regulations and standards, including the International Maritime Dangerous Goods (IMDG) Code. Comments must be received by 28 January 2019. 83 Fed. Reg. 60970 (11/27/18) [].

IMO – biofouling initiative

clip_image008 The IMO issued a news release stating that a global project has been launched to protect marine biodiversity threatened by invasive species transferred via ships’ hulls and other marine structures. (11/26/18) [].

India – port reception facility portal

clip_image010 The Indian Directorate General of Shipping (DGS) issued a circular announcing establishment of a centralized port reception facility portal to facilitate an efficient, effective, and transparent port reception service delivery process. Circular 6-2018 (11/20/18) [].

UK – carriage of dangerous goods

clip_image012 The UK Maritime and Coastguard Agency (MCA) issued a Merchant Shipping Notice revising requirements regarding carriage of dangerous goods and marine pollutants in packaged form so as to incorporate recent amendments to the International Maritime Dangerous Goods (IMDG) Code, MSN 1893 (M) (11/26/18) [].

    logo11 BWM reform

    In the January 2019 edition of Maritime Reporter and Engineering News, you can find my article entitled "BWM reform". The article discusses the recent enactment of the Vessel Incidental Discharge Act of 2018 (VIDA). The Act greatly reforms the process for regulation of ballast water discharges into waters of the United States. It not only brings the US ballast water management (BWM) regulatory scheme into closer alignment with the international standard, but it also largely eliminates the authority of states and tribal govenments to establish their own standards. Full implementation will take time, but there is light at the end of this particular tunnel.
